Instruction, Accompaniment and Obtainment of Authorization for Mineral Research

What is it?

The request for a mineral research authorization is the fastest way to obtain a mining title. The research authorization is linked to the administrative regime known as “Authorization Regime” and allows the execution of mineral research for any mineral substance, except those protected by monopoly (oil, natural gas and radioactive mineral substances), for a determined time and in an area chosen by the interested party.

To obtain this authorization the interested party must, through his technical manager, delimit a region through an “n” sided polygon with a total area defined by law, as follows:

2,000 ha : metallic mineral substances, fertilizing mineral substances, coal, diamond, bituminous and pyrobetuminous rocks, peat, and rock salt;

1.000 ha : rocks for coating, and other mineral substances.

50 ha: the mineral substances listed in art. 1 of Law nº 6.567, of 1978; mineral waters and drinkable table waters; sand, when appropriate for use in the transformation industry; feldspar; gems (except diamonds) and decorative stones, for collections and for making mineral handicrafts; and mica.

Note: 1 ha (hectare) is equivalent to 10,000 m²

Note: In the areas located in the Legal Amazon defined in art. 2 of Law No. 5.173, of October 27, 1966, the maximum limit established for metallic mineral substances, fertilizer mineral substances, coal, diamond, bituminous and pyrobetuminous rocks, peat, rock salt and for the kaolin mineral substance, will be 10,000 (ten thousand) hectares.

How does it work?

After the area and the substance have been defined, the interested party, through its technical manager, submits its request through the Mineral Research Request system (REPEM) of the National Mining Agency (ANM).

Once the analysis of the application is concluded, the ANM will issue in the name of the interested party the Research Permit that will last for 1, 2, or 3 years. During this period the holder of the area must carry out all of his research work to identify the mineral substances of interest.
