Alteration of the Administrative Process Regime

What is it?

The regime change is a technical procedure used to alter the original regime of a mining process. This procedure has specific rules and can be carried out under the following conditions:

For Mineral Research

This procedure will result in the opening of a new application process for a research permit, license registration, or mining permit, as the case may be.

The change of regime will be granted at the discretion of the ANM and will be conditioned, as the case may be

I – to the absence of debts related to the mining process object of the regime change request;

II – the absence of CFEM debts registered in the active debt related to the process object of the regime change; and

III – the area must be adequate to the maximum permitted under the regime of exploitation in question;

IV – the change of regime may be requested from the time of the title request until the final term of validity;

V – the change of the mineral substance required or object of the mining title will be forbidden, unless the holder has previously communicated the existence of another useful mineral substance to ANM.

 

For Mineral Licensing

This is the application that pleads for the change in the mineral use regime. The request will imply in the opening of a new license registration process.

The change of regime will be granted at the discretion of the ANM and will be conditioned, as the case may be

I – to the absence of debts related to the mining process object of the regime change request;

II – the absence of CFEM debts registered in the active debt related to the process object of the regime change; and

III – the area must be adequate to the maximum permitted under the regime of exploitation in question;

IV – the change of regime may be requested from the time of the title request until the final term of validity;

V – a change in the mineral substance required or object of the mining title will be forbidden, unless the title holder has previously informed ANM of the existence of another useful mineral substance.
