The Key Focus of the 2nd Stage: External Audit
Unlike the March cycle, this September phase mandatorily requires hiring an independent external consulting firm. This specialized audit validates the technical analyses, attests to the structure’s stability, and signs the declaration in the system.
DCE submission is mandatory for mining dams included in the PNSB that meet at least one of the following criteria:
- Dam embankment height: Greater than or equal to 15 meters.
- Reservoir capacity: Greater than or equal to 3 million m³.
- Waste type: Storage of hazardous tailings.
- Risk/Impact: High Risk Category (CRI) or Medium/High Associated Potential Damage (DPA).
Failure to submit or late delivery of the DCE results in the immediate and automatic interdiction of the structure via SIGBM, a non-negotiable operational measure until compliance is restored.
However, financial penalties are currently in a transition period. The ANM has launched Public Consultation No. 01/2026 (open for contributions until September 24) to revise ANM Resolution No. 223/2025. This review redefines fine calculation methodologies, penalty metrics, and the handling of repeated infractions.
While operational shutdowns remain strictly enforced, pecuniary penalty standards for non-compliance will be updated following the conclusion of this consultation.
