The National Mining Agency (ANM) establishes distinct mineral exploration regimes in Brazil, adapted to the nature of the activities and the profiles of operators. While industrial mining involves complex processes, ANM also offers simplified modalities and manages the offering of new mineral tenements.
The Licensing Regime applies to the exploitation of mineral substances for immediate use in civil construction, such as sand, clay, and gravel. It is characterized by a more agile regulatory process, contingent on obtaining a municipal license and authorization from the landowner. Following approval of the Licensing Application, the titleholder must annually submit a Production Report (RAL).
The Garimpeiro Mining Permit (PLG) constitutes a specific mineral title for individual artisanal miners or cooperatives. Granted by ANM, the PLG requires, for the commencement of extraction operations, the prior acquisition of the respective environmental license, aligning with sustainability requirements.
The Extraction Registry is an exclusive regime for public administration entities. It allows governmental bodies, at municipal or state levels, to extract minerals such as sand and laterite for direct use in public works, thereby waiving the conventional authorization process in this instance.
In addition to these regimes, ANM administers the Tenement Availability process. When a mining process is extinguished or archived, the respective area may be declared available. The subsequent procedure may involve a public offering or auction, aiming to provide transparent opportunities for access to new mineral exploration projects.
