The National Mining Agency (ANM) announced the opening of Public Hearing ANM No. 2/2025, marking the beginning of the consultation on the draft Edict for the 9th Round of Mineral Area Availability. The central objective of the round, which is expected to offer around seven thousand mineral areas, is to grant the right of priority to the winning applicant to request Exploration Authorization or Development Concession over the areas listed.
The Public Hearing aims to receive contributions regarding the regulation of the Public Offering and the tie-breaking criteria by Auction. This procedure marks the debut of the partnership between the ANM and the B3.
I. Scope, Deadlines, and Participation in the Consultation Process
The Round presents strong potential in critical minerals, such as nickel, lithium, copper, and rare-earths. To prevent speculative movements and democratize access, each participant may register interest in a maximum of 10% of the total areas offered in the round.
- Public Hearing (Online): The event will be held on 18/11/2025, from 14:30 to 17:00.
- Submission of Contributions: The period for sending opinions and suggestions will be from 17/11/2025 to 19/11/2025 (only 3 days).
The draft Edict, which has objective tie-breaking criteria through a sealed-bid auction, is open for consultation under Process SEI nº 48051.003886/2025-31. Requests for clarifications and challenges must be submitted using specific forms available on the SOPLE platform.
II. Provisional Schedule for the 9th Round
The draft presents a detailed schedule, emphasizing that all dates are subject to modification in the final version:
| Phase | Date (Provisional) |
| Publication of the Official Extract and Disclosure on SOPLE | 15/12/2025 |
| Period for Requests for Clarification and Challenges | 19/01/2026 (08:00) to 23/01/2026 (17:00) |

III. Cost and Guarantee Structures (Provisional)
The structure of costs and guarantees is critical and must be analyzed carefully:
| Cost | Value | Observation |
| Registration Fee | R$ 200.00 | Mandatory prerequisite. |
| Declaration of Intent Fee | R$ 150.00 per area | Payment binds the participant to the obligations of their selection. |
| Financial Proposal (Bid Price) | Minimum of R$ 5,000.00 per area | Applicable only to the winning participants (acquirers) in the Auction. |
| Acquisition Fee | Variable Value (Formula) | Due by all participants who acquire areas in the Auction, aiming to cover operational costs. |
| Proposal Guarantee (Security) | 1% of the total value of the financial proposals submitted | Mandatory for proposals equal to or exceeding R$ 1,000,000.00. |
Failure to pay the winning Financial Proposal implies the loss of the right of priority and the application of penalties.
Attention: It is imperative to note that the Edict is in the consultation phase and the draft is subject to 100% modification. The active participation of all interested parties in the public hearing is indispensable to determine the final content of the edict.
