The Regulatory Journey of Industrial Mining: A Technical and Legal Guide to the Phases, from Initial Request to Grant of Mining Concession
Industrial mining in Brazil, both large and medium-scale, is a complex and rigorously regulated process structured in sequential stages by the Agência Nacional de Mineração (ANM). For each phase, the entrepreneur must meet specific requirements, ensuring that the mineral exploration is conducted in a planned manner and in compliance with the legislation.

The culmination of this process is the Mining Concession. This is the administrative act that grants the right to begin exploration of the deposit. Once the concession is obtained, the miner must begin work within six months and fulfill their obligations, such as the payment of royalties and indemnities, in addition to being liable for any environmental damage. This is the most robust regulatory framework for Brazilian mining and the foundation for the country’s major projects.
