The Proof of Aptitude: Detailing the Requirements for the Exploration Authorization


The Prerequisites for the Qualification of Applicants and Projects at the ANM

Aptitude, which attests to the applicant’s capability and the project’s viability, is demonstrated immediately in the first step of the mining cycle: the Application for Exploration (protocolized electronically, via REPEM). For the National Mining Agency (ANM) to consider the plea valid, the Filing of supporting documents is necessary, containing records that prove both the qualification of the individual or company and the seriousness of the project.


Applicant Qualification (Legal Capacity)

The ANM requires the interested party to prove their legal capacity by presenting registration data that vary according to the applicant’s nature:

  • Individual (Brazilian): Name, nationality, marital status, profession, domicile, and the registration number in the Individual Taxpayer Registry (CPF) are required.
  • Legal Entity (Company): The company must provide its corporate name, the registration number of its articles of incorporation in the competent Commercial Registry Body, address, and registration number in the National Corporate Taxpayer Registry (CNPJ).


It is mandatory that the applicant is duly registered in the ANM’s Digital Protocol System, which ensures the traceability and validity of their declaration of intent.


Project Qualification (Technical Aptitude)

The Aptitude of the project is proven by the presentation of a set of technical documents that detail the exploration proposal. The objective is to demonstrate that the Exploration Plan is well-founded, technically viable, and consistent with the nature of the area:

Exploration PlanIndicates the necessary stages for the exploration, including the predicted budget and timeline for its execution. The timeline will define the term for the Exploration Authorization (1, 2, or 3 years).
Technical Responsibility (ART)Proves the Technical Aptitude of the legally qualified professional responsible for the application data; the ART must be duly paid.
Descriptive MemorialDetails the superficial extent of the area (in hectares), indicating the mineral substances to be explored, the Municipality, and the State where it is located.
EmolumentsThe payment of the foreseen emoluments is mandatory. The non-payment of this administrative fee results in the automatic denial of the application.



The ANM has the prerogative to summon the applicant and the responsible professional to justify the Exploration Plan, the budget, and the availability of resources. The non-compliance with the requirements within the fixed deadline may lead to the denial of the habilitation application, confirming that the proof of Aptitude is the most important step for obtaining mining rights.
