The procedure is initiated with the completion of a standardized electronic pre-application form on the ANM’s website, which must be filed in the agency’s “Digital Protocol” System within 30 days. The instruction of the process requires the presentation of precise documentation for its validation. The application must be accompanied by a partial renunciation instrument, signed by the tenement holder or their legal representative, and location and detail maps demonstrating the new geometrical boundary of the remaining area, with the corresponding Technical Responsibility Annotation (ART). It is important to note that the submission of the renunciation term is not necessary if the area reduction was already part of the exploration work report or prepared to comply with an ANM requirement.
Partial renunciation has clear regulatory implications. The mining tenement holder and the leaseholder must have their registrations updated beforehand. Legislation allows for partial renunciation without prejudice to the fulfillment of obligations, such as the submission of the final exploration report. In situations of partial interference with another requested area, the ANM will notify the holder, allowing the exploration permit to be published with a reduced area, unless they file an objection.
After the renunciation is validated, the released area can be declared available by the ANM for new applications. The area reduction, when carried out without displacement, does not alter the original expiration date of the permit, allowing the continuity of exploration and mining work in the remaining area in an unaltered manner.
