Obtaining mining rights in Brazil typically begins with the Application for Research Authorization (Requerimento de Autorização de Pesquisa) submitted to the National Mining Agency (ANM). Beyond the geological assessment, it is essential to understand the regulatory costs. Knowing these values is crucial for planning and executing the research project without unforeseen issues. Legislation and ANM regulations define what must be paid.
The first mandatory cost is the emolument fee for filing the Application for Research Authorization. In 2025, the value set by ANM Resolution No. 196, of February 25, 2025, is R$ 1,297.23. This amount must be paid before filing with the ANM, and the proof of payment needs to be included in the documentation. It is a single administrative fee to process the initial application, regardless of the area size. Furthermore, the Technical Responsibility Annotation (Anotação de Responsabilidade Técnica – ART) must be validated.
After the granting of the Research Authorization, the Annual Fee per Hectare (Taxa Anual por Hectare – TAH) is due. This value is calculated based on the area (in hectares) and paid annually while the authorization is valid. ANM Resolution No. 196/2025 defines the TAH as R$ 4.74 per hectare for the first term. For prorogued permits, the TAH increases to R$ 7.11 per hectare. Payment of the TAH is necessary to keep the tenement regular; failure to pay can lead to the loss of the Research Authorization (caducity).
In addition to the direct costs with the ANM (emolument and TAH), other expenses are necessary. The preparation of the Application and the Research Plan requires a qualified professional (geologist or mining engineer), whose fees are a significant part of the initial investment.
The Technical Responsibility Annotation (ART) also has a cost, which is based on the price of the service provided. Additional consultancies in areas such as regulation or environment may arise.
